A Mutual Separation Agreement between the City of Cape Canaveral and City Manager David L. Greene was approved at the September 17, 2019 Regular City Council Meeting. The Mayor and City Council appointed City Clerk Mia Goforth as interim City Manager to assume the duties of City Manager until a determination is made regarding how best to permanently fill the position. City business will continue as normal during this transition.

I have advised the interim City Manager that in my opinion, it is advisable and customary to withhold any payments under the Agreement until that time period has expired.   Thereafter, as I previously advised, payments should be processed and made in the normal and customary course when an employee leaves employment with the City.  As you have recognized, the Mayor and former City Manager presented this matter to me and the City Council on very short notice.  However, the City Council reviewed the agenda item and decided in their collective wisdom to approve the Agreement (4-1), and it was the Council’s decision to make.  In my legal opinion the Agreement is valid and binding on the City unless revoked by Mr. Greene, and not inconsistent with law including Section 215.425, Florida Statutes.
